Legally, you have only 6 months from the date of grant of probate to contest a Will on the grounds that the deceased has made inadequate provision for you.
Sometime, it depends on a number of factors including the behaviour of the other party to the dispute. Courts may not look favourably on extended delays and cases brought late may be complicated by distribution of the estate having already taken place. If you feel that you have a valid claim, we therefore advise you to take action to protect your inheritance as soon as possible and without delay.
Making a claim against testator’s estate
The limitation for making a claim against testator’s estate is 12 years from the date of death.
Claim against fraud or forgery
There is no time limit if you wish to bring a claim against an estate for fraud or forgery.
